Is Aspergillus Dangerous?

Most people breathe in Aspergillus spores daily without getting sick, but it can trigger allergies and asthma and, in people with weakened immune systems or lung disease, cause a serious infection called aspergillosis. The risk depends heavily on the person.

For healthy people, Aspergillus is mainly an allergen that can cause hay-fever-type symptoms and asthma flare-ups. The danger rises sharply for vulnerable people. The CDC explains that while most people inhale Aspergillus spores every day without harm, those with weakened immune systems or lung diseases are at higher risk of developing health problems—ranging from allergic reactions to invasive infection. This is why an Aspergillus problem is especially concerning in homes with children, elderly residents, people undergoing cancer treatment, transplant recipients, or anyone with asthma or a chronic lung condition.

What Is Aspergillosis?

Aspergillosis is a lung infection caused by Aspergillus, with forms ranging from an allergic reaction to a life-threatening invasive infection that can spread through the body. It mainly affects people with weakened immune systems or lung disease.

Aspergillosis is not a single illness but a spectrum. On the milder end are allergic reactions in people with asthma or sinus conditions; on the severe end is invasive infection in people whose immune defenses cannot clear the fungus. According to federal health authorities, the type of aspergillosis and its severity depend largely on a person’s overall health and immune function, which is why the same household mold problem can be harmless to one person and dangerous to another under the same roof.

Allergic Bronchopulmonary Aspergillosis (ABPA)

ABPA is an allergic reaction to Aspergillus that most often affects people with asthma or cystic fibrosis, causing wheezing, shortness of breath, and worsening respiratory symptoms. It is not an invasive infection, but it can significantly affect quality of life and lung function over time.

Invasive Aspergillosis

Invasive aspergillosis is the most severe form, occurring when the infection moves from the lungs and spreads through the bloodstream to other organs, including the brain, skin, and bones. It typically brings fever, cough, and chest pain, and it primarily strikes people with severely weakened immune systems. It is a serious, potentially life-threatening condition.

Who Is Most at Risk

Those at highest risk for serious aspergillosis include people with prolonged low white-blood-cell counts, blood cancers, and organ or stem-cell transplant recipients, as well as people with chronic lung disease. For these individuals, an unaddressed Aspergillus problem in a rental is not a minor inconvenience—it can be genuinely dangerous.

This is part of what makes Aspergillus cases distinct. With many molds, the harm is limited to allergy-type symptoms; with Aspergillus, a landlord’s failure to fix a moisture problem can expose a medically fragile tenant to a life-threatening infection. When a property owner knows a vulnerable person lives in the unit—or simply ignores a serious mold problem that could harm anyone medically fragile—the stakes, and the potential liability, are higher. Courts and juries understand the difference between a cosmetic issue and a genuine health hazard, and a well-documented Aspergillus case makes that distinction clear.

Symptoms of Aspergillus Exposure

Aspergillus exposure can cause congestion, coughing, wheezing, shortness of breath, and worsened asthma, and in vulnerable people, fever, chest pain, and signs of infection. Symptoms range from mild allergy to serious illness.

The Environmental Protection Agency notes that molds like Aspergillus produce allergens and irritants that can trigger hay-fever-type symptoms and asthma attacks even in people who are not allergic. Milder, common complaints include a stuffy or runny nose, sneezing, coughing, wheezing, red or itchy eyes, and skin irritation. In people with weakened immune systems or lung disease, more serious symptoms—persistent fever, chest pain, coughing up blood, and shortness of breath—can signal an infection that needs prompt medical care. Because milder symptoms overlap with everyday allergies, linking them to mold requires medical documentation, which we help clients build with their providers.

Where Aspergillus Grows in Austin Homes

Aspergillus grows on damp drywall, insulation, carpets, and fabrics, in dust, and especially within HVAC and air-conditioning systems, where it can spread through the air people breathe. Austin’s humid, AC-dependent climate is ideal for it.

Because Aspergillus thrives in warm, damp conditions and spreads through ventilation, Central Texas homes and apartments are prime territory. Common locations include damp drywall and insulation after a leak, carpeting and fabrics that stayed wet, accumulated household dust, and—critically—air-conditioning systems, ductwork, and air handlers that hold moisture. The EPA’s guidance on mold and moisture emphasizes that mold can begin growing within 24 to 48 hours of water exposure and that controlling moisture is the key to prevention. When an HVAC system or a leak spreads Aspergillus through a rental and the landlord fails to address it, that neglect can be central to a claim.

The HVAC connection deserves special attention in Austin. Air conditioners run for much of the year here, and the condensation they generate—combined with dust that collects on coils and in ducts—creates an ideal environment for Aspergillus. When the system then blows air through the home, it can distribute spores into every room, which is why an AC-borne mold problem can affect a whole unit rather than one damp corner. Landlords are responsible for maintaining the HVAC systems they provide, and a known, unaddressed moisture or mold problem in that system can be a significant part of a habitability claim. Documenting the source—whether a drip pan, a clogged condensate line, or leaking ductwork—helps connect the mold to the landlord’s maintenance failures.

Why Aspergillus Keeps Coming Back

Aspergillus returns whenever the underlying moisture source is not fixed—painting over it, wiping it down, or running an air purifier does not solve the problem if the leak or humidity remains. Lasting removal requires fixing the water source.

One of the most common frustrations tenants describe is mold that keeps reappearing no matter how often they clean it. That pattern is a red flag: it means the moisture feeding the mold was never addressed. A landlord who repeatedly sends someone to wipe down or repaint an affected area, without repairing the roof leak, plumbing problem, or HVAC condensation behind it, has not met the duty to remediate—and the recurring growth becomes evidence of that failure. As the CDC explains, the key to controlling mold is controlling moisture; without that, the problem comes back. In a legal claim, a documented history of the same mold returning after superficial “fixes” can be powerful proof that the landlord knew about the problem and failed to truly solve it.

Common Aspergillus Scenarios We See in Austin

Aspergillus problems tend to follow recognizable patterns: contaminated AC systems, water-damaged units after a leak or flood, chronic bathroom and kitchen moisture, and mold spreading between apartment units. Recognizing the pattern helps prove the neglect behind it.

Contaminated Air-Conditioning Systems

A tenant reports a musty smell every time the AC runs, and testing later reveals Aspergillus in the ductwork or air handler. Because the system circulates spores through the whole unit, these cases often involve household-wide exposure, and they turn on the landlord’s failure to maintain and service the HVAC system.

Water-Damaged Units After a Leak or Flood

After a roof leak, burst pipe, or flooding, a unit is not properly dried out, and Aspergillus and other molds colonize the damp drywall, carpet, and insulation. When the landlord did a cosmetic cleanup rather than removing and replacing the water-damaged materials, mold predictably returns.

Chronic Bathroom and Kitchen Moisture

Slow leaks under sinks, poorly sealed tubs, and inadequate ventilation create the steady moisture Aspergillus needs. These problems often build for months while a tenant’s repair requests go unanswered, creating exactly the notice-and-inaction record that supports a claim.

Mold Spreading Between Apartment Units

In multi-unit buildings, a moisture problem in one apartment—or in shared walls, plumbing, or roofing—can spread mold to neighboring units. When a complex ignores a building-wide moisture issue, multiple tenants may be affected, and that pattern can strengthen the case against the owner.

What Proper Aspergillus Remediation Looks Like

Proper remediation means fixing the moisture source first, then removing or cleaning contaminated materials following recognized guidelines—not simply painting over or spraying the visible mold. Superficial cleanup that ignores the water source is not a real fix.

Public health guidance is consistent on the basics: address the water problem, then remove or thoroughly clean affected materials, often discarding porous items like soaked drywall, carpet, and insulation that cannot be fully cleaned. For larger problems, licensed professionals should handle the work with proper containment to avoid spreading spores. When a landlord instead sends someone to wipe down the surface, spray bleach, or repaint over the growth while leaving the leak or HVAC problem in place, the mold comes back—and that inadequate response can itself be evidence of the landlord’s failure to meet the duty to repair. We often use the contrast between what proper remediation requires and what the landlord actually did to show the neglect at the heart of a case.

How Landlords Fight Aspergillus Claims

Landlords and their insurers commonly argue the tenant caused the moisture, that the mold did not cause the health problem, or that they responded reasonably. Knowing these defenses is how we counter them. Preparation defeats these arguments.

Blaming the Tenant for the Moisture

A frequent defense is that the tenant caused the problem—by not running the exhaust fan, keeping the home too humid, or failing to report a leak. We counter this with the maintenance history, the building’s condition, and evidence of the true moisture source, such as a roof or plumbing failure the landlord was responsible for.

Disputing the Health Connection

Because many mold symptoms are non-specific, landlords often argue the illness came from something else. We address this with medical documentation, the treating providers’ opinions, and, where relevant, the heightened vulnerability of the person exposed, building the strongest possible link between the exposure and the harm.

Claiming a Reasonable Response

Landlords may claim they responded appropriately by sending someone to clean the mold. We show the difference between genuine remediation and a cosmetic fix—especially when the same mold returned—demonstrating that the response did not actually address the moisture source as the law requires.

Is My Landlord Liable for Aspergillus in Texas?

In Texas, a landlord can be liable for Aspergillus when the tenant did not cause the moisture, gave proper written notice, is current on rent, and the landlord then failed to repair the problem within a reasonable time. These conditions come from the Texas Property Code.

Texas has no mold-specific statute, but landlords must repair conditions that “materially affect the physical health or safety of an ordinary tenant” under the Texas Property Code, and courts apply this to mold that poses a health risk. Aspergillus cases can be especially serious where a vulnerable tenant is involved, because the health stakes are higher. The key legal question is usually the same: did the landlord know about the moisture or mold problem and fail to fix it within a reasonable time after proper written notice?

State agencies have limited power to help directly. The Texas Department of Licensing and Regulation, which licenses mold assessors and remediators, cannot force a landlord to remove mold. That is why a demand letter or lawsuit from an attorney is often what finally gets a neglected Aspergillus problem addressed. For the complete framework of landlord duties, tenant remedies, and deadlines, see our main Austin mold attorney page.

Who Can Be Held Liable for Aspergillus?

Depending on the situation, a landlord, property management company, builder or contractor, or a home seller who concealed known water damage can be held liable for an Aspergillus problem. Identifying the right defendant is the first step.

Landlords and Property Managers

The most common defendant is a landlord or management company that ignored a leak, let an HVAC moisture problem persist, or delayed repairs. When that neglect allows Aspergillus to spread and harm a tenant—particularly a vulnerable one—it can support a habitability or negligence claim. In apartment communities, both the on-site management company and the property’s owner may share responsibility, and they are frequently separate businesses with separate insurance, which can matter for the recovery available in a serious case.

Builders and Contractors

Homeowners can sometimes pursue a builder or contractor when defective construction or HVAC installation—poor drainage, improper sealing, or a system that traps moisture—allowed the water intrusion that let Aspergillus flourish. These construction-defect claims turn on showing the work was done negligently.

Home Sellers Who Concealed Damage

A seller who knew about mold or a history of water damage and failed to disclose it may be liable under Texas disclosure laws and the Deceptive Trade Practices Act, which require disclosure of known material defects. Concealing a chronic leak or prior mold problem from a buyer can be the basis of a claim.

What to Do If You Find Aspergillus

If you find Aspergillus, document it, give your landlord written notice by certified mail, protect your health—especially vulnerable family members—and keep records, then contact an attorney if the landlord fails to act. These steps protect your safety and your claim.

Document the Mold and the Moisture Source

Photograph and video the mold and the leak, water damage, or HVAC problem behind it, noting dates. Evidence of the underlying moisture source—and when it began—helps prove the landlord had time and notice to act before the mold spread.

Give Written Notice

Notify your landlord in writing, by certified mail or a method with tracking, describing the mold and the moisture problem and requesting repair. Keep a copy. Written, dated notice is a legal prerequisite to the landlord’s repair duty and to most of your remedies under Texas law.

Protect Vulnerable Household Members

Because Aspergillus poses the greatest risk to people with weak immune systems or lung disease, take extra care if anyone in the home is elderly, undergoing cancer treatment, a transplant recipient, or has asthma. See a doctor promptly for any concerning symptoms so there is a medical record.

Keep Records and Call an Attorney

Save every communication, receipt, and medical record. If the landlord ignores your notice or only masks the problem, contact an attorney. Often a lawyer’s letter prompts action; when it does not, we are prepared to file suit to protect your health and your rights.

How We Prove an Aspergillus Case

We prove an Aspergillus case by documenting the moisture source, the landlord’s notice and inaction, the property damage, and the medical link between the exposure and your illness. The vulnerability of the person affected often shapes the case.

As with any mold claim, the timeline is central: we gather your written notices, maintenance requests, photos, and communications to show the landlord knew about the moisture and failed to act. A licensed mold assessor or industrial hygienist can document the presence and extent of Aspergillus, including in HVAC systems, and we work with your medical providers to connect your diagnosis to the exposure. Research summarized by the National Institute of Environmental Health Sciences confirms that people’s sensitivity to mold varies widely, which is especially relevant with Aspergillus, where a vulnerable person can suffer serious harm from exposure that a healthy person might tolerate. We also document damaged belongings and any remediation and relocation costs.

Compensation in an Aspergillus Claim

Aspergillus victims may recover for property damage, remediation and relocation costs, medical expenses, lost wages, and pain and suffering, depending on the facts. Serious infection cases can involve substantial medical damages.

Provable losses usually anchor the claim: belongings destroyed by mold, remediation you paid for, temporary housing or relocation costs, and other out-of-pocket expenses. Where Aspergillus exposure caused or worsened a health condition—especially a serious infection like aspergillosis—you may recover current and future medical bills, which can be significant, along with wages lost to illness. Texas also allows recovery for the physical suffering, anxiety, and disruption of living in an unsafe home. Where a landlord knew of a serious risk to a vulnerable tenant and did nothing, additional damages may be available for that especially egregious conduct.

Asked Questions

most searched topics

How much does an Aspergillus attorney cost?

Nothing upfront. We handle Aspergillus and other mold cases on contingency, so you pay no attorney fees unless we recover compensation. We also advance the costs of investigation and experts, including mold assessors and medical experts. This lets you pursue a claim against a landlord without financial risk during a stressful time.

How much is an Aspergillus claim worth?

It depends on your losses—damaged property, remediation and relocation costs, medical expenses, lost wages, and pain and suffering. Cases involving a serious infection like aspergillosis can carry substantial medical damages. Because Texas requires proof the landlord knew and failed to act, strong notice and medical evidence significantly affect the value of your claim.

Can Aspergillus in my air conditioner make me sick?

Yes. Aspergillus commonly grows in damp HVAC systems and ductwork, which can spread its spores through the air you breathe throughout the home. A contaminated AC system is a frequent source of indoor exposure. If a landlord ignored a known HVAC moisture problem that spread mold, that neglect can support a claim.

Do I need to test for Aspergillus to have a case?

No. You do not need a mold test to pursue a claim, and health agencies do not recommend routine testing—finding and fixing the moisture matters more. Professional assessment, including of HVAC systems, can add helpful evidence, but proving the landlord’s notice and failure to repair is what matters most.

Is Aspergillus worse than black mold?

Neither is simply “worse”—they pose different risks. Aspergillus is more likely to cause infections in vulnerable people, while black mold is known for producing mycotoxins. Both are common in water-damaged homes and both should be removed. For a legal claim, what matters is the landlord’s neglect, not which species the lab found.

Can I sue my landlord for Aspergillus in Texas?

Yes, if the landlord failed to fix a moisture problem you did not cause after receiving proper written notice while you were current on rent. Texas landlords must repair conditions that materially affect a tenant’s health or safety. Aspergillus cases can be especially strong where a vulnerable tenant suffered serious health effects from the landlord’s neglect.

What are the symptoms of Aspergillus exposure?

Common symptoms include congestion, coughing, wheezing, shortness of breath, itchy eyes, and worsened asthma. In vulnerable people, fever, chest pain, and coughing up blood can signal a serious infection. Because milder symptoms resemble allergies, medical documentation is important to link them to mold if you are pursuing a claim.

What is aspergillosis?

Aspergillosis is a lung infection caused by Aspergillus, ranging from an allergic reaction (ABPA) to life-threatening invasive infection that spreads through the body. It mainly affects people with weakened immune systems or lung disease. Invasive aspergillosis can bring fever, cough, and chest pain and requires prompt medical treatment.

Is Aspergillus dangerous?

For most healthy people, Aspergillus is mainly an allergen, but for people with weakened immune systems or lung disease it can cause serious infections. Most people breathe in its spores daily without harm. The real danger is to vulnerable people—children, the elderly, transplant recipients, cancer patients, and those with asthma or chronic lung disease.

What is Aspergillus?

Aspergillus is one of the most common molds, found outdoors and indoors, that grows on damp materials, in dust, and in HVAC systems. Most species are harmless to healthy people, but it can trigger allergies and, in vulnerable people, cause a serious lung infection called aspergillosis. Indoor growth signals a moisture problem a property owner should fix.

My husband and I were in a car accident in December '23 and both sustained spinal injuries. We were definitely overwhelmed getting through the holidays that year, and finding Kelley Wolff helped tremendously. After they accepted our case, they took care of everything to get us set up with medical appointments. The medical process was seamless due to their assistance. We completed treatment within around 4-5 months and then moved from Texas to Colorado - I was worried that this would complicate our case, but they took care to ensure it wouldn't complicate or drag it out.Travis & Colin kept us informed throughout the process, and were very helpful when it came time to give our depositions. We both felt very prepared for the process. Our case ultimately went to mediation, and they ensured we were well-prepared for the mediation, including what to expect during and after. The mediator was able to propose a solution that worked for all parties, which we gladly accepted. Once the funds were approved and allocated, we received checks the next business day.We are so glad to be done with this process, only because it was stressful, but I highly recommend consulting Kelley Wolff if you find yourself in a car accident or other personal injury case. Travis & Colin are both exceptionally kind, brilliant, and thorough attorneys, and I feel confident recommending them to any of my loved ones.
